The High Court in Kabarnet has issued conservatory orders stopping the relocation of Moi Teachers College-Baringo students to Talai Secondary School in order to make way for Kabarnet University.
Justice Reuben Nyakundi issued the interim orders after petitioners Godfrey Rotich, Kaplelach, Lavender Jelagat and two others through their lawyer Edwin Rutto argued that the directive was abrupt, unlawful and threatened to displace more than 1,000 students, teachers and support staff.
The four who had petitioned Cabinet Secretary for Education Julius Ogamba, Commission for University Education and one other told the court that the order issued verbally by the CS during the college’s 29th graduation on July 31, 2025 lacked an official relocation plan and would disrupt ongoing academic programmes and projects.
They claimed that the CS acted beyond his powers by invoking a June 13 Gazette Notice establishing Kabarnet University without proper transition orders.
The petitioners at the same time argued that the alternative institution which is a secondary school lacks equivalent services or educational infrastructure of a Teachers Training college.
They added that it would be a challenge for the students to engage in their ongoing field projects which are already set within the current institution of learning.
Justice Nyakundi in his ruling ordered that the application be certified as urgent and set an inter-parties hearing on August 11 before Justice Patrick Otieno.
