A middle-aged man has been jailed for 20 years by a Kabarnet court for defiling his 15-year-old niece.
Collins Kipkemboi was charged that on unspecified date within the month of October 2024 at Chesamach forest, Kilingot village of Ossen location in Baringo North, he unlawfully committed an indecent act with a child, contrary to section 11(1) of the Sexual Offences Act. 3 of 2006
When arraigned before Senior Resident Magistrate (SRM) Edwin Mulochi the accused denied committing the offence.
The victim told the court that, on the fateful day the uncle requested her to accompany him to a nearby Chesamach forest to gather firewood and she agreed.
“When we reached the forest, he grabbed my hand and pushed me to the ground and defiled me,” narrated the victim to the court.
The complainant said that the accused warned her that he would end her life if she dared to tell anyone about the incident.
The court heard that in January 2025 while at school, the victim started feeling pains in her stomach and decided to visit Kabartonjo sub-county hospital where examinations showed she was pregnant.
The court further heard that when the learner was taken to Kabarnet County Referral Hospital and a scan taken it was discovered that she had miscarried.
Ruling, the SRM said that the heinous act had become rampant and should be discouraged completely and ordered the accused to serve 20 years imprisonment to serve as a lesson to other would-be offenders.
He was, however granted 14 days to make an appeal against the ruling.
