The Garissa Senior Magistrate, Cosmas Maundu on Monday fined a prosecutor attached to the office of Director of Public Prosecution in Wajir Sh.160,000 or in default serves 12 months imprisonment for soliciting for a bribe.
Carey Francis Andai was arrested in Wajir town on 15th of November 2016 by EACC detectives from Garissa following complaints against him.
According to the prosecution, on 14th November the Commission received a complaint from one Mohamed Muhamud, a businessman from Wajir that the accused was soliciting for a Sh. 35,000 bribe as an inducement to fast-track an assault case against the complainant’s daughter.
On 23rd, November 2016, the team from Garissa proceeded to Wajir and laid a trap for the accused whereby they gave the complainant Sh 30,000 treated money to give him.
Immediately Andai received the money the sleuths pounced on him and on searching him recovered the money.
The accused was arrested and locked up at Wajir police station before he was handed to Garissa anti-corruption court where he was charged with soliciting and receiving a bribe On 22nd February 2017.
The accused who listened pensively from the dock as the verdict was read to him was reminded of his right to appeal within 14 day.
Speaking to the press outside the court, the complainant, Mohamed Mohamud welcomed the judgment, noting that it will serve as a lesson to public servants using their positions to defeat justice especially those targeting the common mwananchi.
“Although the case has dragged for over two years finally justice has been served. I want to appeal to Kenyans to stand up for their rights and never to allow state officers intimidate them when seeking for justice,” he said.
The sentencing comes barely a week after two detectives attached to the homicide unit in the Directorate of Criminal Investigations were interdicted over claims they bungled the probe into the killing of Nairobi lawyer, Assa Nyakundi’s son.
The DCI, George Kinoti said the officers had worked with other players in the case to cover up the murder. Kinoti said the incriminated officers will be charged.
